GoLaksh – Terms & Conditions

1. Introduction

GoLaksh (“the Site”) and the Licensed Mobile Application (“the Application”) are owned and operated by Laksh Workforce Solutions Pvt. Ltd. (“Company”). The Site and Application are collectively referred to as the “Platform.” By accessing or using the Platform, you (“User”) agree to be bound by these Terms of Use.

1.1 Acceptance

• Access and use of the Platform are strictly conditional upon compliance with these terms.
• If you do not agree, you must not use or access the Platform.

2. Purpose

The services and products offered via the Platform are intended exclusively for:

• Individuals searching for job opportunities or availing of career enhancement services (“Job Seekers”);
• Individuals/organizations providing genuine job vacancies or acting on behalf of employers (“Recruiters”).

The Platform is a preliminary medium for bona fide exchange of job-related information.

3. Binding Agreement

These Terms of Use constitute a legally binding agreement between you and the Company.

• If using as a Recruiter representative, you confirm authority to bind your organization.
• Use of the Platform indicates acceptance of current Terms & Conditions.

4. Eligibility

By accessing the Platform, you represent and warrant that:

• You are competent to enter into a valid contract under Indian law.
• You are lawfully authorized to use the Platform for its intended Purpose.

5. Permitted Use & Restrictions

5.1 Lawful Use

• Use only for genuine job-seeking or recruitment purposes.
• The Company determines what falls within or outside this Purpose.

5.2 Prohibited Activities

• Copying, extracting, downloading, selling, sharing, modifying, or otherwise exploiting Platform content for any unapproved commercial or competitive purpose.
• Using automated systems (robots, crawlers, etc.) to scrape or manipulate Platform data.
• Unauthorized access, hacking, bypassing security protocols, or attempting to breach system limits (e.g., captchas).
• Impersonation of persons/organizations.
• Uploading unlawful, offensive, infringing, or malicious content; including, but not limited to, viruses, abusive language, deceptive messaging, or material that violates any law.

6. Platform Misuse Consequences

Misuse includes any violation of these Terms or actions deemed inappropriate by the Company.

• The Company may, without notice, suspend or terminate access, remove non-compliant content, or report violations to authority.
• If misuse leads to damage or loss (revenue, reputation, customers), the Company may seek compensation, relief, or injunction.

7. Usage Limitations

You must adhere to all limits imposed by the Company, including:

• Geography/location of access.
• Volume limits (e.g., number of profiles viewed, resumes downloaded per day). Any violation can result in restriction or termination of Platform access.

8. User Information: Accuracy & Correction

• Information provided must be true, complete, and up to date.
• Impersonation or providing false details is strictly prohibited.
• The Company may remove or suspend content or access for inaccuracies or outdated details.

9. Account Security

• You are solely responsible for keeping your login credentials secure.
• Do not share passwords with others.
• Immediately notify GoLaksh of any unauthorized account use via  .
• The Company employs reasonable precautions but does not guarantee complete security.

10. Third-Party Links

• The Platform may contain links to external sites for user convenience.
• The Company is not responsible for the content, privacy policies, or practices of any linked third-party site.
• Accessing such sites is at your own risk.

11. Disclaimer

• GoLaksh is an intermediary as per Section 2(1)(w) of the Information Technology Act, 2000.
• The Platform is not liable for user-generated content or external advertisements.
• Information is provided “AS IS” without guarantees of accuracy, completeness, or timeliness.
• The Platform does not warrant uninterrupted, error-free service and disclaims liability for consequential damages, including repairs due to malware.

12. Decision Making

• Users are solely responsible for independently verifying all information and for making decisions regarding jobs, applications, or candidate selection.
• The Platform does not guarantee any job responses or application outcomes and makes no legal/financial advice or warranties.

13. Limitation of Liability

• GoLaksh/Laksh Workforce Solutions Pvt. Ltd. is not liable for indirect, incidental, special, consequential, or exemplary damages.
• Maximum aggregate liability is limited to the amount paid by the User to the Company for services.

14. Privacy

• Use profile privacy settings to control information disclosure.
• The Platform’s Privacy Policy details data usage, sharing, and protection practices.
• Uploaded/shared information may be viewed or downloaded by third parties.
• Users grant GoLaksh the right to use their activity/actions for ads, suggestions, and recommendations without compensation.

15. Payments, Refunds & Invoices

15.1 Payment Obligations

• Payment for all Platform services must be made 100% in advance.
• All service payments are non-refundable unless explicitly stated otherwise.
• Refunds, if any, are at the sole discretion of the Company.

15.2 Invoice & Taxation

• Tax invoices will be emailed to registered email addresses.
• Service charges are exclusive of all applicable taxes (GST, etc.).
• Users must timely provide TDS certificates where applicable.

16. Use of Payment Gateways

• Payments use third-party gateways; any transaction errors or issues are outside GoLaksh’s control.
• GoLaksh accepts no liability for loss due to incorrect use or third-party fraud.

17. Amendments to Terms

• GoLaksh reserves the right to amend, alter, or update these terms without notice.
• Updated terms are immediately effective upon posting on the Platform.
• Continued usage constitutes acceptance of the revised terms.

18. Intellectual Property

18.1 Ownership & License

• All intellectual property, database, code, trademarks, and designs remain the property of Laksh Workforce Solutions Pvt. Ltd.
• Users are permitted a limited, personal, non-transferable license for Platform use.
• Sublicense, transfer, or copying for commercial or competitive use is forbidden.

18.2 User Content & Suggestions

• Any information or material provided by users is deemed non-confidential and non-proprietary.
• By submitting material, users grant GoLaksh global, royalty-free rights to use, adapt, and publish.
• Users must indemnify and hold harmless the Company for misuse or illegal distribution.

19. Applicable Law & Jurisdiction

• Governed by the laws of the Republic of India.
• Exclusive jurisdiction: Courts of Uttar Pradesh, India.
• Disputes are referred to arbitration under the Arbitration & Conciliation Act, 1996.

20. Severability

• If any term is held invalid, remaining provisions remain effective.

21. Assignment & Delegation

• Users cannot assign, delegate, or transfer any rights granted under these Terms. Any attempted assignment is void.

22. Services “As Is”; Force Majeure

• Services are provided “as is” and “as available” with no guarantee of uptime.
• The Company is not responsible for service interruptions or failure arising from circumstances beyond its control (e.g., natural disasters, regulatory changes, acts of God).

23. Activation Delays

• Because of credit card fraud, services purchased using cards may require verification before activation.

25. Job Seeker Solutions

• By creating a job seeker account, users agree to receive job alerts and communications via email/SMS.
• Resumes may be searchable and accessible to subscribing recruiters.
• The Platform is not responsible for the content of recruiter forms, assessments, or decisions; all authenticity checks must be done independently by the user.
• Certain paid services (e.g., resume writing) become active only upon upfront payment; non-refundable.

26. Recruitment Solutions

• Recruiters may post jobs and access candidates, subject to additional compliance, data protection, and fair-use requirements.
• No advertising, promotion, or spamming is permitted through job postings.
• Usage limits may apply to number of job posts or database views.
• Personal data obtained must be protected and only used for recruitment purposes, with compliance to all applicable laws.

27. Credits and Paid Jobs

• Credits (“GoLaksh Credits”) are required to post paid jobs and use certain features.
• Credits are valid only for the purchased period.
• Unused credits expire at the end of the validity term and are not transferable or refundable.
• Paid jobs are displayed for a fixed period, subject to change with notice.
• No refunds for accidental uses or postings.
